Full Public Notice          Prospectus

PROJECT DESCRIPTION:  Delta Land Services, LLC (DLS), has requested authorization to create an approximate 900-acre wetlands mitigation bank, named Long Island Cove Mitigation Bank (LICMB), within the Galveston District of the Corps. DLS proposes to serve as the property owner, sponsor, and long-term steward of the LICMB.  The purpose of the LICMB will be to provide an effective approach to satisfy compensatory mitigation requirements of the Corps Regulatory Program developed in accordance with the Compensatory Mitigation for Losses of Aquatic Resources [73 Fed. Reg. 19594, 10 April 2008 (codified in 33 CFR 332)].  A Mitigation Banking Instrument (MBI) would be developed following the aforementioned policy and would detail the legal and physical characteristics of the bank and how the bank would be established and operated.  Subjects addressed in detail in the MBI would include development of the site, service area, credit determination, financial assurances, scope of agreement, purpose and goals of the bank, baseline conditions, performance standards for restoration or enhancement activities, accounting procedures, monitoring and reporting, long-term maintenance and protection, and transfer of bank ownership or sponsorship.  The applicant will be working with the Corps and other Federal and State resource agencies (the Interagency Review Team-IRT) in the development and approval of the MBI.

The proposed geographic service area for the LICMB includes a primary and a secondary service area.  The proposed primary service area includes the USGS Lower Trinity Subbasin (HUC 12030203), excluding the portion which consists of the Texas/Louisiana Coastal Marshes Level IV Ecoregion. The secondary service area is proposed as the HUCs comprising the remainder of the Trinity River Basins (i.e., Trinity, Neches-Trinity, and Trinity-San Jacinto River Basins) excluding the portions of these HUCs consisting of the Mid-coastal Barrier Islands/Coastal Marshes and the Texas/Louisiana Coastal Marshes Level IV Ecoregions.  Specifically, these HUCs consist of the portion of the Lower Trinity-Kickapoo Subbasin (HUC 12030202) which is within the South Central Plains Level III Ecoregion and the Sabine Lake Subbasin (HUC 12040201), East Galveston Bay Subbasin (HUC 12040202), and North Galveston Bay Subbasin (HUC 12040203); solely within the boundaries of the Galveston District and within the State of Texas.
